Family who owns controversial purple playground celebrates big win against HOA

LEE’S SUMMIT, Mo. — A neighborhood celebrates a big win, and a happy ending for one family. A judge ruled Friday that a controversial purple playset can stay. The Raintree Subdivision’s Home Owners Association said the family put the playset up without their permission and didn’t like the color it was. Sunday, the neighborhood came together for a celebration BBQ.
“We’re super excited, we’re very happy,” said Marla Stout, who owns the playset.
Stout said she thinks the HOA should apologize to the entire neighborhood.
“It’s been very embarrassing for our community and its cost every resident in this community a lot of money and reputation,” she told FOX 4 on Sunday.The family said they were threatened with jail time from the HOA over the playset’s color. According to the HOA, children’s play equipment must be within harmony of other colors in the community. The family’s attorney said the home owner’s restrictions weren’t clear.
“I think it said a lot that the judge took a week to review the case, review the facts, review everything,” said T.R Hoefle. “I’m thrilled with the decision she made.”
FOX 4 reached out to the HOA Sunday but has not yet heard back.
