NORTH CAROLINA – NC Woman May Be Evicted From Mobile Home Park For Flying American Flag

Yet another HOA dispute over the American Flag. This one has a bit of a different twist. The Association has decided to ban ALL flags because someone wants to erect a distatsteful flag.

So, treating adults just like children, the decision is to disallow all flags.

Ever hear of the First Amendment?

Oh, wait, the HOA industry claims the Bill of Rights Need Not Apply, since Associations are private corporate organizations subject to the CC&Rs “contract” rather than government entities.

But there is also a Federal Law, Freedom to Display the American Flag Act of 2005 (signed in 2006) that is supposed to prohibit an Association Governed Residential Community from abridging the right to display the American Flag.
